What happens if you do nothing

Not scare stories: these are the rules as they stand, from GOV.UK and the Office of the Public Guardian, and most families meet them for the first time at the worst possible moment.

    What an unmarried partner inherits without a will

    Nothing. Married partners get the first £322,000 and half of the rest; the children take the other half, even if that means the house has to be sold to pay them out.

    The savings figure above which you pay every penny of care

    A care home costs £60,000 to £80,000 a year. Once savings fall below this figure the council steps in, and the house counts as savings unless someone protected lives in it. Most families find out at the assessment.

    The day pensions join the estate

    Unused pension pots are counted for inheritance tax from this date. Above the bands the rate is 40%. About one in five pensioner households would be over the line, most without knowing it.

    The court fee if you lose capacity without a power of attorney

    Your family cannot simply step in. They apply to the Court of Protection for a deputyship: £432 to apply, medical evidence, months of waiting, an annual supervision fee, and the accounts frozen in the meantime. An LPA costs £92 to register now.

Questions before you buy

Is the will legally valid?

Yes, once it is signed properly. In England and Wales a will is valid when it is in writing, signed by you in the presence of two adult witnesses, who then sign in your presence. Will writing is not reserved to solicitors. The plan drafts it from a standard form of words, a person checks it against your answers, and the signing guide walks you through the witnesses. If your estate is one that needs a solicitor, the plan tells you so and does not give you a draft to sign.

Why £89 when a will can be free?

A free will through Free Wills Month or Will Aid is a good route and we point you to it every time. The plan is everything around the will that nobody else does in one place: the house trust answer, the care and tax figures for your own house, the power of attorney pack done right first time, the family sheet, and a person checking the lot.

What if my situation is complicated?

A previous marriage or step-children, a business or overseas property, someone you want to leave out, a dependant on benefits, an estate over £1m, or a will trust for the house: any of these and the plan says clearly that you need a solicitor, and gives you complete instructions to take to one. You still get everything else, and the refund promise still applies.

Is there a refund?

Yes. Within 14 days of buying, one email and it is refunded in full the same day.

Do I need to be good with computers?

No. One question at a time, big type, no account or password, and it saves as you go. Sons and daughters often do it with a parent over a cup of tea.

Doing this for Mum or Dad?

Choose “My mum or dad” when you buy. You can fill everything in and share the link with them. Nothing is signed or decided on the screen; the will is theirs to read and sign, and the check is written for you both.

Is it advice?

No. It is information, your own figures and a will drafted from your answers, set out clearly. Only a solicitor or an FCA-authorised adviser can advise. We are not a law firm and we say so on every page.

What happens after the Budget on 28 October 2026?

We update the rules and email you if your figures change. The April 2027 pension change is already built in.
